Apprehending arrest in connection with Crime No. 132 of 2017 registered for the offences punishable under Sections 143, 353, 332, 186, 206, 120B of the Indian Penal Code read with Sections 5, 5A, 9 and 9A of the Maharashtra Animal Preservation Act, 1976 the applicants seek pre-arrest bail.

The crime is registered on the compliant lodged by the Police Head Constable that the applicants were transporting bullocks for slaughtering and when the vehicles in which the bullocks were being transported were stopped, the applicants had not produced any document asked for, had a scuffle with the police staff and forcibly took away five bullocks.

The application is opposed on the ground that investigation is in progress.

2 aba513.17 The non-applicant has not been able to point out that custody of the applicants is required for investigation. The applicants claim to be agriculturists and have stated that they are not involved in any other crime/ offence. In the facts of the case, following order is passed: In the event of arrest in connection with Crime No.132 of 2017, registered by the non-applicant, the applicants be released on bail on executing P.R. Bond for Rs.Twenty Thousand each.

The application is allowed accordingly.
