By the order dated 25.08.2021 passed in Writ Petition No.2671 of 2021, the respondent nos.1 and 2 herein were granted time to decide the representation preferred by the petitioner seeking extension of the concession period for collection of toll. The decision was to be taken on 04.09.2021. The grievance of the petitioner is that till date the said representation has not been decided and instead there is a threat that the petitioner should stop the collection of toll.
Shri Ulhas Aurangabadkar, learned Assistant Solicitor General of India on instructions from the respondent no.1 submits that the communication dated 04.10.2021 clearly states that until the decision is taken on the representation of the petitioner, the petitioner has been permitted to continue to collect the toll. Though the communication states that the same can be done till 15.10.2021 it is also further stated that until further directions such arrangement can continue. In view of aforesaid, we find that the apprehension of the petitioner is taken care of. As regards the subsequent communication dated 21.10.2021 issued by the respondent no.2 which is taken on record and marked 'A' for identification, it is submitted that appropriate instructions in that regard would be tendered to the respondent no.2 to act in accordance with communication dated 04.10.2021.
