Learned counsel for the applicant Mr. Sk. Shabahat Ullah submits that he has instructions to withdraw the present application, since the Court is not with the applicant. He submits that a necessary direction be issued to the Trial Court for expeditious disposal of the Special Case filed against the applicant under the Provisions of Narcotic Drugs & Psychotropic Substances [NDPS] Act.

Prayer is accepted. Criminal Application [BA] No. 589 of 2015 is dismissed as withdrawn.

Speedy trial is the right of the applicant who is languishing in jail. In that view of the matter, The Special [NDPS] Court, Nagpur, is directed to dispose of

the Special Criminal Case No. 28 of 2015 within a period of nine months from the date of receipt of this order. Application is disposed of in above terms.
