Heard Shri S. K. Bhoyar, Advocate for the appellant and Shri V.G Bhamburkar, Advocate for the respondent Nos.1 to 3.

The learned Advocate for the appellant states that cheque for the amount required to be deposited is with him and will be deposited within one week.

If the amount is deposited within two weeks, the interim order granted on 16th March, 2016 shall continue until further orders. The civil application is allowed in the above terms.

Considering the facts of the case, in my view, the respondent Nos.1 to 3/claimants can be permitted to

2 caf2622.16 withdraw Rs.9,00,000/- from the amount which will be deposited by the appellant. The respondent Nos.1 to 3 be given Rs.3,00,000/- each.

The balance amount be kept in fixed deposit in nationalized bank until further orders.
