IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH : NAGPUR Writ Petition No. 557/2021 Shri Narendra Balram Khewale and ors.

...Petitioner

Versus

The Additional Commissioner, Nagpur and ors.

...Respondents

Shri S.K. Patil, Advocate for the Petitioner Mrs. K. R. Deshpande, AGP for the Respondent No. 1- State CORAM : NITIN JAMDAR AND ANIL S. KILOR, JJ.

DATED : 15 FEBRUARY 2021 P.C.:

Heard learned Counsel for the Petitioner and learned AGP for the Respondent No. 1.

2.

In view of the limited relief and the order we propose to pass, it is not necessary to issue notice to the Respondent Nos. 2 and 3. 3.

The Petitioner, a teacher dismissed from service on 07 August 2020 and who had filed an Appeal on 15 September 2020, prays that a direction be issued that the Appeal be disposed of within a time bound period.

The Appeal is filed in September 2020. Due to Covid-19 Pandemic, the functioning of various bodies have been disrupted. It is on that count perhaps that the Appeal has not been decided. We, therefore, do not find the delay in disposal of the Appeal so unreasonable that this Court should issue a Writ of Mandamus fixing a timeline. However, considering the fact that the Petitioner, a teacher is removed from service, the Appellate Authority will consider his prayer taking up the Appeal for consideration as early as may be feasible.

5.

Writ Petition is accordingly disposed of.
