The claimant has filed this application praying that he may be granted some time to pay the deficit court fees. The claimant has stated that his land is acquired and amount of compensation is not given to him and therefore, he is not in a position to pay the deficit court fees. In the connected appeal i.e. First Appeal No. 673 of 2016 an order is passed today permitting the claimant to withdraw the amount. The learned advocate for the applicant-appellant, on instructions, states that the deficit court fees will be paid within eight weeks.

Accepting the statement made on behalf of the appellant, eight weeks' time is granted to the appellant to pay the deficit court fees.

If the deficit court fees is not paid within eight weeks, the appeal shall stand dismissed without reference to the Court.

The civil application is allowed in the above terms.
