After admission of the appeal, the parties have arrived at an amicable settlement.
Shri Rohit Joshi, learned counsel for the appellants, states that on 23.10.2018, the parties have recorded a mutual agreement as a result of which the dispute stands settled. As per that arrangement, the decree passed by the trial Court declaring the plaintiff as owner of field Survey No.323/1 would operate. The said land stands acquired by the Western Coalfields Limited and the plaintiff has agreed to pay part of the compensation to the defendants.
Accordingly, the Second Appeal stands disposed of in terms of compromise dated 23.10.2018. Needless to state that the same is subject to realization of the cheques issued by the plaintiff. With the disposal of the Second Appeal, all pending civil applications also stand disposed of.
