The allegations in this matter are that the applicant has duped many women villagers, asking them to form a group and deposit amount to avail the facility of the bank and on deposit of such amount, the applicant and other accused persons failed to return back the amount to the complainant and other women members of the group. On a complaint made by the complainant, Crime No. 821 of 2021 was registered with Police Station Arni, Dist. Yavatmal for the offence punishable under Section 420 read with Section 34 of Indian Penal Code.

This Court on 26th October, 2021 granted ad-interim anticipatory bail to the applicant and accordingly, he attended the police station on every Sunday in between 12 .00 noon to 2.00 p.m to cooperate the Investigating Officer in investigation. It is

2 6-aba708-21 submitted that the applicant has not misused the liberty and there is no such complaint.

Today, learned counsel for the applicant makes a statement on instructions that the applicants are ready to deposit Rs.2,00,000/- jointly in the trial Court to show their bonafides.

As the applicants were granted ad-interim anticipatory bail on 26th October, 2021 and since October, 2021, the applicants have been attending the police station on every Sunday and as there is no allegation of misuse of liberty by the applicant, I am of the opinion that this is a fit case to confirm ad-interim anticipatory bail. Accordingly, I pass the following order.

ORDER

i.

The criminal application is allowed.

ii.

Order dated 26th October, 2021 is confirmed subject to deposit of Rs.2,00,000/- by the applicants jointly in the trial Court as per undertaking given by the applicants, within four weeks. On failure to deposit the said amount, the application shall stands rejected.
