DATE : 30/08/2022 This application is for speaking to minutes seeking correction in the order dated 02.08.2022. 2] In para 3 of the order the description of the property is given as "admeasuring 3500 sq.ft i.e. 50x17 along with a house constructed thereupon situated at Mouza Hartala as described in para 2 of the plaint (page 40)", the same is sought to be corrected by the description of the property in para 2 of the plaint (page
42) as under :
"A Two Storeyed house i.e. a building situated in Balaji Plots near Diparchan on Badnera road, Amravati, taluq and district Amravati, situated within the Municipal Corporation Limits of Amravati City, on Nazul Plot No. 1/34, Sheet No. 66-C, admeasuring 4944 sq.feet."
So also in SCS No. 222/95, the plaintiff is Smt.Jyoti w/o Sanjay Deshmukh and the name of "Smt. Jyoti" is sought
(2) 4caw1860.22 to be inserted in line no. 3 on page 2 of the order before "Sanjay Deshmukh".
3] In the Writ Petition No. 1945/19, in spite of service, none appeared for the L.Rs of Respondent No.1 and the Respondent Nos. 2 to 8 are proforma respondents as they had relinquished their share in favour of the present petitioner and no notice was issued to them, there is no reason to issue notice to the them on this application, as it merely seeks clarification of the order dated 2.8.2022.
4] The corrections sought to be done are in consonance with the preliminary decree passed in SCS No. 222/96 (page 38 and 42), considering which the application is allowed. The appropriate corrections be carried out in the order dated 2.8.2022 and corrected order be uploaded, indicating it to have been corrected in pursuance of the application having been allowed. 5] Civil application stands disposed of.
