On 02.08.2019 this Court passed an order as under.
"The claim of the petitioner for '
Kirat/Kirad' caste, which is recognized as Nomadic Tribe (B) category, is pending for the decision by the Scrutiny Committee, however, the college is taking adverse action against the petitioner.
Issue notice for final disposal of the matter, to the respondents, returnable on 27.09.2019.
Mrs. Naik, learned A.G.P. waives service of notice for respondent nos.1 and 2.
By way of adinterim order, the admission of the petitioner shall stand protected. The petitioner shall be permitted to appear in the examination and the result shall be subject to the decision of the petition."

In response to the aforesaid order, the reply is filed by the Scrutiny Committee and the petitioner has also
2 89.WP5440.19.odt placed on record Certificate of Validity dated 18.11.2019. It is an undisputed position that this petitioner possesses Certificate of Validity of 'Kirad' Nomadic Tribe (B) category. 3.
In view of this, the petitioner is entitled for all the benefits and consequently, continuation of education as a student legally admitted in the course in question. 4.
Petition stands disposed of.
