Apprehending arrest in connection with Crime No.191/2017 registered for the offence punishable under Sections 143, 342, 394, 323, 506, 364A and 365 of the Indian Penal Code, the applicant seeks pre-arrest bail. According to the complainant, the applicant and his accomplices raised dispute that the complainant was not allowing his wife to go to her matrimonial house and abducted the complainant and committed the offence as reported.

According to the applicant, the complainant refused to send his wife to her matrimonial house and there had been some dispute on that point between the complainant and his in-laws and the applicant tried to mediate, however, the complainant lodged false

2 aba517.17 complaint against the applicant on the basis of which crime is registered against him.

The learned Advocate for the applicant has pointed out that this Court has passed an order on 6th July, 2017 directing that the co-accused Mayur, Santosh and Maroti be released on bail in the event of arrest in connection with same crime.

The applicant, aged about 47 years, claims to be the Sarpanch and has stated that he is not involved in any other crime / offence. The non-applicant has not been able to point out that custody of the applicant is required for investigation. Considering the facts of the case and nature of accusations against the applicant, following order is passed:

In the event of arrest in connection with Crime No.191/2017 registered by the non-applicant, the applicant be released on bail on executing P.R. bond for Rs.10,000/- (Rs. Ten Thousand) and furnishing one solvent surety in the like amount.

The application is allowed accordingly.
