Mr. D.N. Kukday, Adv. [appointed] for the applicantAppellant. Ms. Deshmukh, APP for respondent.

----- CORAM : A.B. CHAUDHARI AND P.N. DESHMUKH, JJ.

DATE : 13th January, 2015.

This is an application for condonation of delay of 2572 days in filing the Criminal Appeal against the Judgment and Order of conviction and sentence awarded to the applicant.

Heard learned counsel for the applicant.

Accepting the reasons furnished in the application to be sufficient and satisfactory, the application is allowed and delay is

condoned.

---- Learned Adv. [appointed] Mr. Kukday for the appellant submits that there was a common Judgment and Order in other appeals, namely Criminal Appeal Nos. 480 of 2007, 70 of 2008 and 500 of 2010, filed by other three accused persons and those appeals appear to have been dismissed by this Court. According to him, this appeal, however, remained pending in this Court for want of legal aid. Ultimately, this Court appointed Mr. Kukday to take care of the present appeal.

Heard.

Admit.

We further find that it is not necessary to have a separate paper-book, since the record and the paper-books in other appeals are available with the Registry. Registry is, therefore, directed to retain entire record for disposal of the present appeal.

Since the appeal relates to the year 2006, we would like to hear the appeal itself on merits. Put up on 27th January, 2015. A copy of the paper-book from the said appeals be supplied to Mr. Kukday.

Stand over to 27th January, 2015 at Sr.
