CORAM

: P. N. DESHMUKH & MRS.SWAPNA JOSHI, JJ.

DATE : 2.11.2018.

These applications are placed on record by respondent nos. 3 and 4 to bring on record fact that both the petitions are rendered infructuous in view of information to petitioner no.1 by the Chief Executive Officer, Zilla Parishad, Gondia that, as per Government Resolution dt.19.7.2011, petitioners' grievance in the present petitions does not survive.

In view of the applications as aforesaid and considering the fact that both the petitions were filed by the petitioners requesting to hold and declare the Government Resolution dt.26.2.2008 to be arbitrary and illegal claiming to be not to be enforced upon the petitioners, who are appointed before 1.11.2005 (appears to be wrongly mentioned as 'before 31.2.2005') and are confirmed on the said post after 1.11.2005.

211wp4550.10 2/2 In view of the facts as aforesaid as Government has clarified it's position by issuing Government Resolution dt.19.7.2011, no cause survives in the petitions. Both the petitions are accordingly disposed of. The Civil Applications also stand disposed of.
