The learned counsel appearing for the applicant has filed this Miscellaneous Civil Application to transfer the petition, which is filed by the non-applicant before the Extra Joint Civil Judge Senior Division, Chandrapur to the Family Court, Yavatmal.

The learned counsel for the applicant has stated that the applicant is staying at Yavatmal with her two years old son. It is not possible for her to take him to Chandrapur to attend the matter at Chandrapur Court, hence, she prayed to transfer the petition from Extra Joint Civil Judge Senior Division, Chandrapur to Yavatmal Court.

Though, the non-applicant is served, is not present.

Heard the learned counsel for applicant.

The applicant is staying at Yavatmal with her son. The non-applicant has filed the divorce petition. The maintenance petition filed by the applicant is pending before the Yavatmal Court and the non-applicant is attending the said proceeding. It will be convenient for both the parties to attend the matter in one Court i.e. before the Family Court, Yavatmal.

Hence, the Miscellaneous Civil Application is allowed. The Petition No.116/2020, which is pending before the Extra Joint Civil Judge Senior Division, Chandrapur is transferred to the file of Family Court, Yavatmal.

Miscellaneous Civil Application stands disposed of.
