CRIMINAL APPLICATION (APPA) NO. 674/2021 5.

The appellant/applicant was convicted in Sessions Case No. 206/2015 by the Additional Sessions Judge, Nagpur vide judgment and order dated 18.08.2021 for offence punishable under Sections 279, 332, 337, 353, 427 of the Indian Penal Code and Section 184 of the Motor Vehicles Act. The maximum sentence awarded is to undergo rigorous imprisonment for six months. All sentences were directed to run concurrently. The Trial Court imposed total fine of Rs. 83,000/-.

During trial, the applicant was on bail. He has deposited entire fine amount in the Trial Court on the date of conviction. Since the applicant expressed his desire to challenge the judgment and order of conviction in higher Court, on his application, the Trial Court has suspended the execution of sentence. Having regard to this fact, execution of substantive sentence stands suspended till final disposal of appeal.

In the meantime, the applicant shall be released on bail on the same terms and conditions as imposed by the Trial Court while suspending sentence.
