This application moved before this Court under Section 11 of the Arbitration and Conciliation Act, 1996, for appointment of sole Arbitrator. This Court vide order dated 23.11.2021 appointed one Mr. R.K. Ganeriwala, Chartered Accountant, as the Arbitrator.

During the pendency of the arbitration proceeding, the parties arrived at settlement and they avail the conciliation proceeding and in view of the agreement/memorandum of family settlement arrived at between the parties and after reading the same, all the parties have signed the same on 20.08.2022 and accordingly, the conciliation proceeding was closed. In the above referred backdrop, the present application came to be filed with a prayer for termination of mandate of sole arbitrator in view of the award by the counsellor and agreement between the parties. 5.

Considering the above referred facts and the prayer made in the present application, the application is allowed in terms of prayer clause-1.
