The present application is filed by the applicant for restoration of the present First Appeal, which was dismissed in default on 05.08.2005 for non depositing the deficit Court fee. The reasons stated for doing so are in paragraph Nos.4 and 5 of the present application. In view of the aforesaid reasons, the present application is allowed.

The appellant undertakes to supply the deficit Court fee within one week.

After the deficit Court fee is deposited by the appellant, the Registry to restore the present First Appeal No.529/1996 to the file of this Court.
