With consent, this petition is disposed of in the following order :

(i) A statement is made by the learned Central Government counsel Ms. Mugdha Chandurkar, on the basis of instructions received from the Deputy Director of Enforcement Directorate at Nagpur Shri Sanjay Bangarkar, who is personally present, that the Enforcement Directorate shall not take any coercive step pursuant to the notice of eviction dated 20.10.2021, till 25.11.2021.

(ii) The statement is graciously made since presently the appellant tribunal is not functional.

wp789.2021.odt (iii) The petitioner is at liberty to seek appropriate relief before the appropriate forum till 25.11.2021. (iv) It is made clear that in no event shall the concession/statement made be extended after 25.11.2021.

(v) It is further made clear that the petitioner shall not create any third party interest in the attached property till the order of attachment is in force, unless the order is stayed or is set aside in appropriate proceedings.
