Perused the charge-sheet. There is only one eye witness namely a boy aged about 9 years, who is son of the applicant. I have perused the statement of the boy which is in question-answer form. The applicant is in jail since 04.12.2014.

In the light of the nature of evidence quoted by the prosecution and the charge-sheet having been filed coupled with the fact that learned counsel for the applicant makes a statement that during the pendency of the trial the applicant shall stay out of the city of Khamgaon, following order is passed.

ORDER

(i) Criminal Application No.595/2015 is allowed.

(ii) Applicant-Madhusudan Shrikrushna Gole, be released on bail in Crime No.225/2014 registered with Police Station, Khamgaon City, Dist. Buldana, for an offence punishable under Section 302 of the Indian

ba595.15 Penal Code, on he executing P.R. Bond in the sum of Rs.20,000/- with one surety in the like amount. (iii) The applicant shall not enter the city of Khamgaon and shall inform his place of residence to Police Station, Shegaon (Rural). If the applicant enters Khamgaon, the prosecution is at liberty to apply for cancellation of his bail.

(iv) The eye witnesses shall be under surveillance of the police.

(v) The applicant shall not tamper with the prosecution evidence.
