This is an application of condonation of delay of 896 days caused in filing the first appeal. This is an claimants' appeal whose claim before Railway Claims Tribunal was dismissed. The appellant contended that, he being illiterate, he was not informed the decision of Tribunal by concern Advocate. It is submitted that learned Counsel for the appellant before the Tribunal has been shifted to Mumbai.
For these reasons, the appellant was unable to file appeal within stipulated period. The Respondent though served remain absent, leaving the cause for delay unresisted. Having regard to this fact, delay stands condoned. Civil Application stands disposed accordingly.
