Apprehending arrest in connection with Crime No.359 of 2017, registered for the offence punishable under Sections 376(2)(h), 376(2)(n), 417, 504 and 506 of the Indian Penal Code, the applicant seeks pre-arrest bail. The crime is registered on the complaint lodged by the prosecutrix who is married and aged about 25 years. The complaint is lodged against the applicant, his father, his mother, his brother and his friend. According to the prosecutrix, the applicant assured to marry her and sexually exploited her because of which she became pregnant. According to the prosecutrix, the applicant developed physical relationship with her on 8th February, 2015 and continued to sexually exploit her. The complaint is lodged on 16th June, 2017.

The applicant aged about 24 years, claims to be in private service and has stated that he is not involved in any

2 aba520.17 other crime/ offence. The non-applicant has not been able to point out that custody of the applicant is required for investigation. The reply filed by the Investigating Agency before the Sessions Court (copy of which is filed along with application at page 23) prima-facie shows that the complaint is lodged by the prosecutrix to pressurize the applicant and his family members.

Considering the facts of the case, following order is passed:

In the event of arrest in connection with Crime No.359 of 2017, registered by the non-applicant, the applicant be released on bail on executing P.R. Bond for Rs.Ten Thousand.

The application is allowed accordingly.
