NAGPUR BENCH, NAGPUR MICELLANEOUS CIVIL APPLICATION NO.824/2016 IN WRIT PETITION NO. 3789/2016 (Ashish s/o Ruprao Deshmukh and others vs. The State of Maharashtra and others ) .............................................................................................................................................. Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's order of directions and Registrar's orders .............................................................................................................................................. Mr. P.S.Kshirsagar, Advocate for the petitioners Mr.A.A.Madiwale, Assistant Government Pleader for respondent no.1 & 3 Mr. J.B.Kasat, Advocate for Respondent no. 2 CORAM : SMT. VASANTI A NAIK & MRS. SWAPNA JOSHI, JJ.

DATED : 11th August, 2016 Heard.

We do not find any ground to review the order dated 20/7/2016 in Writ Petition No.3789/2016.

However, since it is the claim of the petitioners that some of the petitioners are transferred to a place which is at a distance of more than 100 - 200 kms. from the place of the posting of their spouse, it would be necessary for the respondent-Zilla Parishad to consider the representation made by the spouse of such petitioners to the Zilla Parishad for their transfer in the same tribal areas in which the petitioners are posted, Shri J.B.Kasat, the learned counsel for the respondentZilla Parishad states that if the spouse of such petitioners are ready to locate themselves in the tribal areas where the petitioners are posted, they may make an application-

representation for their transfers to the same tribal area and the Zilla Parishad would consider the same appropriately. Hence, we dispose of the Review Application with a hope and trust that the Zilla Parishad would consider the application made by the spouse of the concerned petitioners for their transfer to the tribal areas where the petitioners are transferred, within a short time, so that the policy of giving a place of posting to the spouse within a short distance, could be implemented, as far as possible.
