Insofar as prayer clause (a) in the writ petition which seeks a direction to the respondents to continue Managing Committee of the petitioner's society till fresh elections are held, in the reply filed by the respondent no.2 reference is made to the provisions of Section 73 (AAA) of the Maharashtra Co-operative Societies Act, 1960. By amending the same a proviso is added, which provides that the existing Managing Committee to continue till fresh elections are held and new Committee is duly constituted.
In view of that prayer clause (a) stands answered. By prayer clause (b) the petitioner seeks a clarification with regard to the phase under which the elections to Managing Committee would be held. In the reply filed by the respondent no.2 it has been clarified that the elections to the Managing Committee of the petitioner's Society would be conducted in four phases and as of now the elections to the third phase are under way.
