On the rejection of second appeal under the Right to Information Act, the present writ petition came to be filed.

The petitioner applied under Right to Information Act and requested to supply the log books in relation to Police Station Vehicles namely MH-31 AG-9877, MH-31 AG-9628, MH-31 DZ-0115. The Information Officer within the stipulated period given the reply to the petitioner that the record is old and is not traceable and some of the record got damaged.

Whereupon, the first appeal was filed which was rejected on the ground that within a stipulated period the Information Officer replied and as the record is not available, an inability was shown.

Thereafter, the second appeal was filed which came to be rejected on the same ground, vide order dated 07.06.2022.

Thus, considering the reasons recorded by the authorities below and also the reasons for non availability of the information, I do not find any error committed by the State Election Commissioner in passing the impugned order. Accordingly, the writ petition is dismissed.

The fees of the appointed counsel be quantified and paid in accordance with the rules.
