Perused the impugned award. It is seen that reliance has been placed upon the determination made by another reference Court in LAC case which was of Rs.1,50,000/- per hectare, and it has been found to be of similar land. Of course, the rate determined by the Land Acquisition Officer was of Rs.26,000/- per hectare, it has been, now, raised at Rs.1,50,000/- per hectare.

In view of above, I am of the opinion that this application can be conditionally allowed and it is allowed accordingly. The claimant is permitted to withdraw 50% of the amount deposited in this Court

FA869.17 on his furnishing usual undertaking and the remaining 50% amount on furnishing solvent surety to the satisfaction of the learned Registrar (J), within four weeks from the date of order.

The application stands disposed of accordingly.
