This is an application for cancellation of bail granted by this Court to non applicant-Ajay Arun Dantulwar by order dated 12.11.2013 and since then he is on bail in Crime No.143/2013 registered with Police Station, Ghuggus for an offence punishable under Section 306 r/w Section 34 of the IPC.

This application is filed by the State for cancellation of bail. The application was filed on 13.08.2014 in this Court and since then it is pending in this Court without any orders. The only ground for cancellation of bail is that non applicant-Ajay did not attend Police Station and did not maintain diary and that there is no cooperation from him for investigation and, therefore, investigation could not be completed.

appln74.14 The grounds for cancellation of bail raised by applicant-State are too sketchy and do not convey anything. The applicant is on bail for almost 11⁄2 years and I do not think that the order of bail should be cancelled now. Further, this application was filed in August-2014. The same was never pressed at appropriate time with any seriousness. Even otherwise, the reasons mentioned in the application and arguments before me do not make out any case for cancellation of bail.

In view of above, I pass the following order.

ORDER

(i) Criminal Application No.74/2014 is rejected.
