Considering the facts of the case, in my view, the respondent No.1 can be permitted to withdraw Rs.3,00,000/- on furnishing undertaking before the Registrar (J.) of this Court that if at the time of hearing it is found that the respondent No.1 is not entitled for the amount withdrawn by him, he will re-deposit the amount with the Registry of this Court alongwith interest as may be directed by this Court within two months. The civil application is allowed in the above terms.
