Apprehending arrest in connection with Crime No.97 of 2017, registered against the applicant and another accused for the offence punishable under Sections 326, 323, 504 read with Section 34 of the Indian Penal Code, the applicant seeks pre-arrest bail.

The facts on record show that the quarrel started over a trivial issue of parking of motorcycle by the complainant at a particular place.

The application is opposed on the ground that the accusations against the applicant and co-accused, specifically the language used by them before assaulting the complainant shows that they are having criminal minset.

Be that as it may, the non-applicant has not been able to point out that any recovery is to be made from the

2 aba521.17 applicant or custody of the applicant is required for further investigation. The applicant, aged about 30 years, claims to be a labourer and has stated that he is not involved in any other crime/ offence.

Considering the facts of the case and nature of the accusations against the applicant, following order is passed: In the event of arrest in connection with Crime No.97 of 2017, registered by the non-applicant, the applicant be released on bail on executing P.R. Bond for Rs.Ten Thousand and furnishing one solvent surety in the like amount.
