By this application, the applicant is seeking quashing and setting aside of the order below Exhibit 138, dated 17/04/2025, passed by the learned Extra Joint District Judge, Nagpur, in Sessions Trial No. 548/2022.

Heard learned counsel for the applicant and perused the application along with the impugned order. It reveals from the application that no grounds are mentioned in the application, and therefore, the same was not considered by the Court. However, the Court has permitted to recall some of the witnesses. 3.

Learned counsel for the applicant submitted that omissions and contradictions which are material, were required to be asked by the earlier counsel, and the said evidence is required for a just decision of the case. However, this specific ground was not mentioned rkn

In view of the above, learned counsel for the applicant seeks permission to withdraw the application with liberty to file before the trial Court by contending all the reasons.

In view of that, the application is disposed of with liberty to file before the trial court, and the trial Court shall consider the application on its own merit. The criminal application is disposed of.
