Apprehending arrest in connection with Crime No.0240/2017 registered by the non-applicant for the offences punishable under Sections 306, 498-A, 504 read with Section 34 of the Indian Penal Code, the applicant seeks prearrest bail. According to the Investigating Agency, co-accused Anil had been torturing his wife-Vanita and making demands because of which Vanita committed suicide. It is alleged that the applicant is sister of Anil and had been frequently visiting the house of Anil where her parents are also residing and she instigated Anil.

The applicant, woman aged about 35 years, claims that she is working as Anganwadi Sevika and residing at Pusad alongwith her husband and two sons. The distance between Pusad and Kopra is 20 kms.

2 aba522.17 By the order dated 24th July, 2017 this Court has granted interim protection to the applicant. The investigating Agency has not complained that the applicant has not cooperated with it. The non-applicant has not been able to point out that custody of the applicant is required for investigation.

In the facts of the case, following order is passed: In the event of arrest in connection with Crime No.0240 of 2017, registered by the non-applicant, the applicant be released on bail on executing P.R. Bond for Rs.Twenty Thousand and furnishing one solvent surety in the like amount.

The application is allowed accordingly.
