S. Shegaonkar, Advocate for the petitioner Mr. S. V. Purohit, Advocate for respondent nos. 1 and 3 Mr. S. D. Ingole, Advocate for respondent no. 2 Mr. I. J. Damle, APP for the State/respondent no. 4 CORAM: ANIL L. PANSARE AND SIDDHESHWAR S. THOMBRE, JJ.
DATED : 01-10-2025.
The petitioner's son suffered death because of electrocution while on duty with contractor engaged by respondent no. 2, who is sub-contractor of respondent no. 5 engaged by respondent no. 1. The case of the petitioner is that death occurred because of negligence of respondent nos. 2 and 5. Thus, the relief mainly appears to be against the private contractors. Nonetheless, the counsel for respondent nos. 1 and 3 submits that the case, as put forth, will attract civil liability and, therefore, the petition may be converted into civil writ petition.
Learned counsel for the petitioner seeks time to take instructions.
List in next week.
