Heard Shri Kothale, learned counsel for the applicant and Mrs. Patil, learned counsel for the respondents.

Perused the record of writ petition. It appears that on 01.10.1997, this Court has passed the following order :

"Rule returnable early. However, the post shall be subject to the result of this petition."

Therefore, the filling of posts by the respondents was subjected to the result of writ petition. This fact could not be noticed on 31.08.2012 as the counsel for the petitioner did not remain present. We, therefore, disposed of the challenge as infructuous. We recall the order dated 31.08.2012 and place Writ Petition No. 2019 of 1996 before the appropriate Bench for its consideration on merits.

MCA (Review) is thus allowed and disposed of. No order as to costs.
