This is an application for condonation of 56 days' delay caused in preferring appeal against the judgment and order dated 9/2/2018 passed by the learned Chief Judicial Magistrate, Wardha, thereby acquitting respondent of the offences punishable under Sections 279, 338 and 304-A of Indian Penal Code. From the grounds mentioned in paras 3 to 6 of the application, it is noted that delay caused is satisfactorily explained. It is found that there is no intentional delay caused in preferring appeal. Though learned Counsel for respondent has opposed the application contending that delay is not satisfactorily explained, we find no substance in the said contention. The application is, therefore, allowed. Appeal be registered.
