The applicant is arrested on 30th June, 2017 in connection with Crime No.1024 of 2017, registered against him for the offence punishable under Sections 65(a) and 83 of the Maharashtra Prohibition Act, 1949 and Section 188 of the Indian Penal Code.

According to the Investigating Agency, on getting information that a huge quantity of liquor was being transported in the car (Maruti-Suzuki/Swift Desire) bearing registration No. MH-49/ AE-3689 a trap was laid, car was stopped and on search liquor worth Rs.3,50,000/- was seized. According to the Investigating Agency, the applicant was driving the car and was arrested on the spot. The applicant, aged about 28 years, claims that he is running a garage at Ghogli, Besa, Nagpur. The vehicle in question is not owned by the applicant. The applicant has stated that he is not involved in any other crime/ offence.

2 ba688.17 The non-applicant has not been able to point out that custody of the applicant is further required for investigation. In the facts of the case, following order is passed: The applicant, having been arrested in connection with Crime No.1024 of 2017, registered by the non-applicant, he be released on bail on furnishing cash security of Rs.Fifty Thousand and one solvent surety in the like amount. The application is allowed accordingly.
