The matter is called out twice today. However, none present for the appellant/ original complainant in the matter of appeal challenging the acquittal of the respondent for the offence punishable under Section 138 of the Negotiable Instruments Act.
Earlier, for non-service on the respondent i.e. acquitted accused, the present appeal was dismissed by this Court. Thereafter it was restored. Thereafter amendment was sought by the appellant giving changed address of the respondent. After that, amendment was effected and notice was issued against the respondent on the changed address. Subsequently, the respondent appeared through an Advocate and on two occasions the counsel for the respondent sought for time. This happened on 10th June, 2014 and 25th June, 2014. Prior to that and thereafter also none was present for the appellant/ original complainant. So also the situation today.
As such, the present appeal is dismissed for want of prosecution and accordingly disposed of.
