By Company Appeal No. 10/2010, the appellants - Akola Zilla Kamgar Sangh (INTUC), through its President - Pradeepkumar s/o Popatlal Vakharia and Akola Oil Industries Limited, through its Secretary - Motilal Shankarlal Apurwa, have put forth following prayers :
"1) Reject the OLR No. 1/2010;
2) Direct the Respondent Liquidator to reconsider the claims of the workmen and staffs as filed by the appellants;
3) Direct the respondent - Liquidator not to release the amount in the form of dividend or otherwise till the cross examination of the Auditor and till claims of the workers and staffs are finally settled;
4) Any other relief which this Hon'ble Court deems fit and proper in the facts and circumstances of the case, in the interest of justice."
2] By O.L.R. No. 1/2010, the Official Liquidator sought permission to declare dividend @ 9% to the workers. Dr. Anjan De, learned Counsel for the
13-CAP-10-2010 Official Liquidator, submits that subsequently, the Official Liquidator has released 100% dividend to the workers. Accordingly, he is not pressing for orders below O.L.R. No. 1/2010.
3] Thus, it appears that the dues of the workers have been paid and, therefore, the applicants are absent.
4] Accordingly, Company Appeal No. 10/2010 is dismissed for want of prosecution.
5] O.L.R. No. 1/2010 is disposed of as not pressed for orders.
