The applicants, Nigerian nationals are arrested in connection with Crime No.4095 of 2016 for the offences punishable under Sections 420 and 468 of the Indian Penal Code and Section 14 of the Foreigner Act, 1946 on the accusations that in spite of the fact that their VISA had lapsed/ expired, they continued to stay in India illegally. The application is opposed on the ground that if the applicants are released on bail it will not be possible to secure their attendance at the trial.
Considering the facts of the case, I am not inclined to grant the prayer made in the application. The application is dismissed, however, the trial Court is directed to expedite the trial.
