This application is preferred for modification of order dated 22.04.2016.

By order dated 22.04.2016, this Court directed the Co-operative Court to decide the dispute on merits within six months and the promotions granted by the respondent to some petitioners were made subject to the decision of the dispute.

The dispute is however not entertained on the ground of lack of jurisdiction and for identical relief the Civil Court is moved. The submission of the applicants is that the promotions be made subject to the result of the suit which is filed before Civil Court.

Learned Counsel for the respondent has no objection to such modification.

The application is allowed and it is directed that

2 901 ca 1603 of 2017 in wp 2128 of 2016 the promotions of the applicants shall be subject to the result of the suit.
