DATE : 02/12/2021 The basic grievance is that the order dated 12.8.2021 passed by Respondent No.2, has been challenged in appeal before Respondent No. 1. However, since there is no regular incumbent holding the office of Respondent No. 1, the Respondent No. 2 has been given the charge of the said office, as a result of which the appeal against the order dated 12.8.2021 is not being heard.

Mr. Gawande, learned counsel for the petitioner and Mr. Jawade, learned counsel for Respondent Nos. 4 to 7 are agreeable that the appeal filed by the petitioner can be transferred to the Deputy Director of Land Records, Nagpur, for hearing, considering which, without going into the merits of the matter, the petition is disposed of by transferring the Appeal filed by the petitioner against the order dated 12.8.2021 passed by Respondent No.2, to the Deputy Director of Land Records,

The Respondent No. 2 who is in-charge of the office of Respondent No. 1 shall transmit the entire record and proceedings to the Deputy Director of Land Records, Nagpur, within a week of receipt of this order. Parties to appear before Deputy Director of Land Records, Nagpur, on 13.12.2021 and mark their appearance by producing the copy of this order before him, who will thereafter proceed to decide the appeal after receipt of the record, as per law. Petition is accordingly disposed of in above terms.
