The appellant is convicted under Section 324 of the Indian Penal Code and is sentenced to suffer rigorous imprisonment for one year and to payment of fine of ₹ 2000/-. 2.
This Court suspended the sentence and granted bail, vide order dated 29-09-2010.

Since then, there is no appearance on behalf of the appellant. The paper book is not collected.

The note of the registry is that the Bail Writ was received back with the endorsement that the appellant is already released since he completed the sentence.

It is apparent that this appeal is not being prosecuted since the appellant has already served the sentence. While
apeal 528.10.
2/2 ordinarily I would not have disposed of a Criminal Appeal in the absence of the appellant, in the peculiar facts, rather than keeping the appeal pending, the same can be disposed of with a rider that if the appellant is interested in prosecuting the appeal in order to remove the stigma, he would be entitled to seek restoration.

The appeal is dismissed in default, in the light of the peculiar circumstances, with liberty to the appellant to seek restoration within the next six months, if he is interested in prosecuting the appeal in order to wipe out the stigma or otherwise.
