Considering the nature of the accusations, the fact that the victim is intellectually challenged and that the offence is registered under section 376 (2)(I) of the Indian Penal Code, we cannot, and will not, quash the first information report on the basis that the mother of the intellectually challenged victim has entered into compromise with the petitioner.

In view of our disinclination to entertain the petition, the learned counsel for the petitioner seeks leave to withdraw the petition.

The petition is dismissed as withdrawn.
