Learned APP Mr. P.V. Bhoyar submits that during pendency of the present application for bail, the Investigating Officer filed a charge-sheet before a Court of Law.
Said statement is not disputed by the learned counsel for the Applicant Mr. R.L. Khapre. Not only that he has already filed entire copy of the charge-sheet also, which shows that the charge-sheet is filed subsequent to filing of the present application.
In that view of the matter, learned counsel Mr. Khapre submits that he wishes to withdraw the present application in order to file an application before learned Trial Court in view of subsequent filing of the charge-
sheet.
Prayer is accepted. Applicant is permitted to withdraw the present application with liberty to the applicant to file a bail application afresh before the court below in view of subsequent filing of the charge-sheet. It is made clear that this Court has not heard applicant on merits. Needless to mention that liberty will be there to the applicant if his application filed before court below subsequently is not considered favourably.
