This is an application for grant of bail in connection with Crime No.463/2021 registered with Amadapur Police Station, taluka Chikhali, district Buldana for offences punishable under Sections 354-A and 504 of the Indian Penal Code and under Sections 11 and 12 of the Protection of Children from Sexual Offences Act, 2012. 2.

Heard learned counsel Shri S.M.Awachar for the applicant, learned counsel Shri M.N.Ali for complainant, and learned Additional Public Prosecutor Ms T.H.Udeshi for the State.

After rejection of application for grant of bail before learned Judge below, the applicant has approached to this Court. On 29.10.2021, this Court (Coram : Rohit B.Deo, .....2/-

J.) issued Notice to the non-applicant/State. The State has also filed its reply. During pendency of the application, Investigating Officer filed chargesheet and, therefore, with permission of the Court on 24.11.2021 chargesheet is already filed on record.

I have gone through contents of the chargesheet.

Looking to allegations made against the applicant and quantum of punishment, I am of view that the applicant's case can be considered favourably. Resultantly, I pass following order:

ORDER

(1) The criminal application is allowed.

(2) Applicant-Shankar s/o Rambhau Jadhav be released on bail, in connection with Crime No.463/2021 registered with Amadapur Police Station, taluka Chikhali, district Buldana for offences punishable under Sections 354-A and 504 of the Indian Penal Code and under Sections 11 and 12 of the Protection of Children from Sexual Offences Act, 2012, on his executing a P.R.Bond in the sum of Rs.5000/- with one solvent surety of the like amount.

(3) The applicant is directed to attend the police station once in a month i.e. on 3rd Saturday of every month between 2:00 p.m. and 5:00 p.m., till trial is over.

(4) The applicant shall not give any type of threat to the .....3/-

victim so also to prosecution witnesses.

With this, the criminal application is allowed and disposed of accordingly.
