The learned counsel for the respondent, on instructions, submits that respondent is willing to approach the Maharashtra Administrative Tribunal, for the reliefs sought in the suit. It is submitted that application for withdrawal of the suit and proceedings under Order 39, Rule 2-A of the Civil Procedure Code, 1908 will be made before the learned trial court on the next date. It is however, submitted that the interim order passed by the learned trial court be continued for a period of three months. 2.

The statement is accepted as undertaking to this Court.

Considering the facts and circumstances of the case, liberty as sought is granted. The interim order passed by the learned trial court in favour of the respondent shall remain in operation for the period of three months.
