The applicant (wife) seeks transfer of the proceedings filed by her under the provisions of the Protection of Women From Domestic Violence Act 2005, from the Court at Bhandara to the Court at Nagpur. According to the applicant, as her mother requires regular treatment from Doctor at Nagpur, she has shifted to Nagpur, and therefore the proceedings be transferred to the Court at Nagpur. The applicant has filed certain documents to show that her mother is taking treatment from the Doctors at Nagpur.
The applicant is having a sister who is also living with her. The recording of the evidence is going on in the proceedings.
2 appln50.18 In the facts of the case and considering the reasons for which the transfer is sought, I am not inclined to exercise the jurisdiction under Section 407 of the Code of Criminal Procedure.
The criminal application is dismissed. In the circumstances, the parties to bear their own costs. JUDGE Ansari
