At the request of learned counsel for the applicant/appellant, name of non-applicant No.2/respondent No.2 is permitted to be deleted from the array of non-applicants/respondents.

Amendment be carried out forthwith.

Considering the reasons mentioned in the application, delay in filing the first appeal stands condoned. The civil application is disposed of as such. First Appeal St.No.16526 of 2015 Heard.

In the present appeal, judgment passed by learned Commissioner under Workmen's Compensation Act .....2/-

caf2489.15 is under challenge.

The appellant and respondent No.1 have filed on record joint Pursis, vide Stamp No.11102 of 2015, in which it is stated that the claim for compensation is settled at Rs.6,00,000/- (Rupees Six Lacs Only) and respondent No.1 would be entitled to withdraw the said amount deposited before learned Commissioner under Workmen's Compensation Act. The said joint Pursis is signed by respondent No.1 who is present in the Court today. In view of the said joint Pursis, the first appeal is disposed of in aforesaid terms.

Respondent No.1 would be entitled to withdraw the aforesaid amount of compensation deposited by the appellant.
