: 11 SEPT., 2015 By the present application, the applicant is seeking his enlargement on bail since he is arrested in connection with Crime No.231/2014 registered with police Station, Kalmeshwar, Distt. Nagpur for the offences punishable under Sections 419, 420, 423, 467, 468, 471, 474 of the Indian Penal Code.

Heard Shri Rai, learned Counsel for the applicant and Shri Bangadkar, learned A.P.P. for the State. The report is lodged by Salim Akhtar Javed Husain. According to the FIR, the present applicant had purchased land belonging to the Trust. It is further allegation of the prosecution that the original owner never executed the sale deed in favour of the present applicant. It is to be mentioned that the witness to the sale deed by which the present applicant was become owner,

1109ba601.15.odt 2/2 Rafat Maksood Alam is released on bail by this Court on 09/4/2015. The role attributed to said Rafat Maksood Alam that he has identified the executant of the sale deed in favour of the applicant as owner of the land in dispute. The investigation is over and the charge-sheet is already filed. All the offences are triable by the Magistrate. Further, custodial interrogation of the applicant is not necessary. In that view of the matter the application needs to be allowed.

The application is allowed.

Applicant Sheikh Irfan Sheikh Abdul be released on bail on his executing a P. R. Bond in the sum of Rs.50,000/- (rupees fifty thousand only) with two solvent sureties in the like amount in connection with Crime No.231/2014 registered with police Station, Kalmeshwar, Distt. Nagpur for the offences punishable under Sections 419, 420, 423, 467, 468, 471, 474 of the Indian Penal Code. The applicant shall attend police station, Kalmeshwar once in a month, i.e. on last Saturday of every month till culmination of the trial.
