Apprehending arrest in connection with Crime No.516/2023 registered with Police Station Warora, District - Chandrapur, for the offence punishable under Sections 188, 273, 328 of the Indian Penal Code and Sections 26(1), 26(2)(i), 26(2)(iv), 27(3)(e) and 30(2)(a) of the Food Safety and Standard Act, the applicant has filed this application for anticipatory bail.

Heard the learned counsel for the applicant as well as learned APP for the State and I have gone through the case diary.

It appears that the Police raided the shop of the applicant and seized stock of tainted tobacco of worth Rs.6,22,909/-. It was handed over to the Prity

2 / 2 25.aba510.2023 Food Safety Inspector. On the complaint of Food Inspector, offence came to be registered against the applicant. The contraband article has already been seized by the investigating agency, therefore, immediate custody of the applicant is not required. 4.

The applicant was protected by the adinterim order dated 03.08.2023. It is stated by the learned counsel for the applicant, pursuant to the direction given by the Court, that the applicant has attended the concerned Police Station twice.

The applicant was not immediately arrested by the police. The contraband article has already been seized and Panchanama is already prepared. These go to show that the investigation is already completed and custodial interrogation of the applicant is not required.

In view of above and considering the nature of allegations, the case is made out for grant of anticipatory bail. Hence, this order:
