Heard the learned Counsel for the applicants and the learned A.P.P. for the State.

The learned Counsel for the applicants, on instructions, states that he is not pressing the application of applicant No.1. The application of applicant No.1 is, therefore, disposed of as not pressed.

As regards the application of applicant No.2, I find that he is similarly situated to one co-accused Sk. Shoeb Sk. Firoz, who has been granted bail by the Sessions Court on 02/07/2016 and that order has been confirmed as it has not been challenged by the State. In these circumstances, this applicant too deserves to be granted benefit of parity and accordingly it is directed that applicant No.2 - Sk. Bilal Sk. Mujib be released on bail on his furnishing a P.R. Bond in the sum of Rs.20,000/- together with one solvent surety in the like

ba.688.16 2 sum on the conditions that he shall regularly attend the Court proceedings on the dates fixed by the trial Court in the matter, shall co-operate with the trial Court in expeditious disposal of the case and shall not tamper with the prosecution witnesses in any manner.
