Learned Adv. Mr. G.B. Hemke for the applicant submits that during pendency of present application, the Investigating Officer has filed a charge-sheet. In that view of the matter, learned counsel for applicant submits that permission be granted to withdraw the present application.

The prayer is accepted.

Criminal Application [BA] No. 605 of 2015 is dismissed as withdrawn.

The applicant shall be at liberty to file a bail application afresh before learned Trial Court in view of subsequent development of filing of a charge-sheet. Learned Trial Court to consider such application in

accordance with law.

It is made clear that the case of the present applicant is not at all considered by this Court on merit. Application is allowed to be withdrawn with the aforesaid observations.
